Citing ‘Difficult Hurdle’ of Predominance Requirement, Texas Appeals Court Reverses Class Certification in Life Insurance Case

Citing the “difficult hurdle” of class certification’s predominance requirement, a Texas appellate court has ruled a trial court wrongly certified a class of life insurance beneficiaries who claim the insurance company should have been paying out statutory interest from the time of the policyholder’s death.

The Ninth Court of Appeals at Beaumont has ruled that the trial court abused its discretion in certifying a class of all Texas-resident beneficiaries or heirs who were paid death benefits during the class period based their connection to American General Life Insurance Co. policyholders.
