Citing Lack of Evidence, 8th Circ. Tosses Radiologic Tech’s Employment Claims

The U.S. Court of Appeals for the Eighth Circuit upheld a lower court’s dismissal of a radiologic technologist’s sex discrimination, hostile work environment and other claims.

In a Feb. 28 opinion, the appeals court ruled against plaintiff Courtnay Bell, affirming the U.S. District Court for the Eastern District of Arkansas in granting of summary judgment to the Baptist Health Medical Center-North Little Rock and Dr. Kapil Yadav after finding there was no evidence to substantiate Bell’s claims of sex discrimination, retaliation, hostile work environment, constructive discharge, and negligent retention.
