Talc Bankruptcy Lawyers Raise ‘Serious Concerns’ About Future Claims Rep

Lawyers in the second talc bankruptcy sparred on Wednesday over the possible reappointment of a future claims representative, whose role is critical to resolving all the cancer litigation against Johnson & Johnson through a Chapter 11 reorganization plan.

Johnson & Johnson subsidiary LTL Management, which filed for Chapter 11 last month, moved to reappoint Randi Ellis, who served as the future claims representative in its first bankruptcy before a federal appeals court threw the case out. As the future claims representative, Ellis was tasked with ensuring that the interests of individuals diagnosed with cancer in the future were considered when drafting a bankruptcy reorganization plan.
