Alaska’s Division of Elections failed to strictly comply with election law deadlines when it removed a candidate that withdrew from a special election after the primary but before the general election, the Alaska Supreme Court held April 28.
However, because the elections division properly applied a statutorily mandated 64-day time limit that prevented the addition of the special primary’s fifth candidate to the special general election ballot to the special general election ballot, and because there were no constitutional violations to voters’ rights, the state supreme court upheld summary judgment in favor of the division.
