2nd Circuit Panel Appears Skeptical of Elon Musk’s Effort to Remove Tesla Tweet Monitor

Quinn Emanuel Urquhart & Sullivan partner Ellyde Thompson faced skepticism from a three-judge panel of the U.S. Court of Appeals for the Second Circuit on Thursday as she asked the court to modify a consent decree requiring Elon Musk to seek approval from a Tesla attorney before tweeting about the electric car maker.

U.S. District Judge Lewis Liman of the Southern District of New York previously denied Musk’s motion to modify the consent decree, which was part of the resolution to a U.S. Securities and Exchange Commission enforcement action against Musk after he suggested on Twitter in 2018 that he would take Tesla private.
